Got response from Cost Rules Administrator on my complaint of overcharges. She upheld my complaint.

Duncanville's attorney had already contacted her several weeks ago; this is just confirmation of what was already known to me and Duncanville.

Received attorney general letter ruling OR2011-09852 in the mail. While it did not support my case on access to license plate numbers, it did substantially uphold my right of access to Duncanville's red light camera records.

Through communication with Alexis Allen, I confirmed that the attorney general also upheld my objection to their excessive fees: "we have contacted the Cost Administrator and were informed that they do not consider RedFlex a contractor, so the amount for programming is limited to $28.50 per hour."

Alexis now says Duncanville is determining how it can redact the license plate numbers from reports.

Alexis wrote back, saying "In order for the City to accurately respond to your request it is necessary that you clarify the request as noted in our letter dated April 22, 2011." She included an excerpt of the April 22 letter, which asked me to clarify whether I am requesting the following sensitive data:

Detection Date, Detection Time, Location, Vehicle Speed, Time Camera Triggered, Duration in Intersection, Vehicle Lane, License Plate Number, License Plate State, Zip Code of Registered Owner, Citation Number, Citation Status, Status Date, Citation Issue Date and Fine Amount.

Excerpt of my response:

I am requesting all data related to each red light violation stored on Duncanville’s behalf by Redflex, so this would include the personally identifying information (PII).
 
To be clear, I am requesting this data in compliance with statutory provisions allowing for disclosure for my statistical analysis purposes. I am taking significant steps to prevent redisclosure of the data, including strong encryption; I will not contact persons listed in the data; and I will destroy statutorily-protected data once my research concludes or if I determine I no longer need it, whichever is sooner.

I wrote Alexis back, explaining that the Excel spreadsheet is not the responsive data as it does not include the facts of each red light violation. I also said that I would appreciate them initiating an Attorney General opinion on whether I may get license plate numbers.

Alexis wrote back with:

I will forward you a copy of the sample in the electronic format I received it in.  As mentioned in our letter dated April 22, 2011, if this sample does not satisfy your request, you will need to respond to our request for clarification of your April 15, 2011 letter.  If this sample is not sufficient and you submit a clarification of your request, I anticipate that we will seek an Attorney General opinion concerning whether the license plate numbers are excepted from disclosure or, as you have asserted, would be subject to release per Section 730.007.  You will have the opportunity to submit your opinion on the matter to the Attorney General at that time.

She later submitted a copy of some data in Excel format. (The data is a summary of monthly activity and is not usable for this project.)

Alexis Allen provided the attached response over email along with this note in the email:

Attached is the City of Duncanville's response to your April 15, 2011 Public Information Act request.  Per your request, I have attached as the last page a sample of the report offered as option 1 in our earlier cost estimate.  Please let us know if this will satisfy your request.  In the event that it does not satisfy your request, we have asked that you clarify the request.

Received attached notice from Texas Attorney General saying that my open records request has been withdrawn.

Emailed Alexis Allen, CCing Dara Crabtree, saying that this was a complete surprise and that all along I was under the impression we are awaiting an open records opinion on Duncanville's February 8, 2011 letter to the Texas Attorney General.

Alexis wrote back, emphasizing "You must respond in writing to this estimate of charges within thirty (30) business days of your receipt of this estimate or your request will be deemed automatically withdrawn."

I wrote Dara, CCing Alexis, asking for the simpler feed outlined in their response to my original proposal.

Alexis wrote back, saying:

As we’ve discussed in previous emails, your January 27, 2011 request has been deemed automatically withdrawn based on your failure to respond to the cost estimate within 30 days.  Therefore, if you still would like the information you will need to submit a new request in writing, listing the information you are requesting, and we will respond accordingly.

Dara wrote back with "I will keep you posted and see what can be done.  Our Court Administrator is working to see what information is available to us in the reports at this time."

Dara wrote back later offering paper copies at a standard rate. I wrote back clarifying that the request is strictly for electronic data.

Dara wrote back explaining that Redflex handles Duncanville's red light camera system and that Duncanville cannot produce the data that I requested. I asked if Redflex can directly export the data on Duncanville's behalf and that I can refund Duncanville for these costs.

Dara wrote back asking what time frame I want. I replied that I want the data from the beginning of Dunvancille's program, which is 2006.
