I emailed Stephen with these points:

The letters to the TAG from Redflex showed some confusion on Redflex's part. I felt it would be good to clarify a few things.
 
First, I am not requesting that Redflex create a custom report. I am simply requesting a dump of their citation data. If Redflex has a clean, modern information architecture, they should be able to dump the data directly from their databases into a text format, provided that they include explanation of any non-obvious fields.
 
Second, I am not requiring Redflex to email the responsive data to me in one file. In my original request, I identified a few methods of transferring the data, and if neither work, I am open to other ways of transferring the data.
 
Third, Redflex was concerned that I am asking for certain data they do not track. In fact, I am only asking for facts of each red light violation that Redflex stores on Grand Prairie’s behalf.

Stephen Alcorn responded with:

I read the opinion, and have called the contact at Redflex to figure out how to accomplish the transfer of information.  I have not heard back from them.  My suggestion is to have someone there contact you to let you know what you need, and how they can get it to you.  I don't intend on getting the information from Redflex and then transferring it to you--I think that would be too complicated and involve too many people. 

I said that is not a problem.

Texas Attorney General Open Records Division basically upheld all my objections except they did not address open questions on what 730.007, Transportation Code, entitles me to receive. I have a call into the Open Records Division to find out.

Emailed Reyna Pyka and Steve Alcorn asking them to get back with me once they've had time to digest the letter. Also said I will formally object to the estimated $700 cost as excessive.

Received open records response from Teresa Coomes that basically passed the same letter from RedFlex as previously received. The new letter is attached.

My letter to the Texas Attorney General is also attached.

Received copy of letter from RedFlex Director of Operations Robert G. Salcido to Grand Prairie (attached, pages 3-5) that made these points:

  • The request includes data that they got from the NLETS that they think should not be redisclosed.
  • That releasing the data would cause substantial competitive harm and should be exempt per Texas Public Information Act Sec. 552.110.
  • No report exists, so it would require programming time to set one up. They estimate $700 (4 hrs at $175 per hour) to get the data.

Grand Prairie attorney Stephen R. Alcorn asked the Texas Attorney General for an opinion on this request.

I wrote back with these main points:

  • I am not intending to gain proprietary data.
  • I am fine discussing directly with RedFlex.
  • RedFlex selectively interpreted the laws that prohibit disclosure of confidential information. In fact, Texas Transportation Code Ch. 730 and 18 U.S.C. § 2721 both have provisions that all release of the data to me.

Cathy replied back with:

Thanks Aren.  I've forwarded your request to Sgt. Eric Hansen in our Police Department for response.

Eric later replied with concerns that this could require "several hours researching and populating a database with the information you requested". He will work with the vendor to find more info.
