Marivi Gambini, Paralegal, called and wrote saying that some of the information is protected from disclosure. I called back and discussed Texas Transportation Code section 730.007, which permits disclosure to me. She wants me to send her another letter from my faculty research advisor to ascertain this.

I emailed my advisor to request the letter be sent.

Received extensive email from Karen Brophy, Sr. Assistant City Attorney, with these major points:

  • "The information you request is collected, assembled and maintained for the municipal court judiciary. As such it is not subject to the Public Information Art. 552.0035  Release is governed by Rule 12 Texas Rules of Judicial Administration."
  • Municipal court judge will allow release of data with conditions:
    • I submit certian identification information.
    • I and my institution will give binding representation of compliance with provisions of Transportation Code Chapter 730 and detail how data will be handled and secured.
    • I will provide a copy of the final report.
    • The court will only release the name and address per 730.007(b).
  • Identified certain records that cannot be delivered.

Received mailed copy of perfunctory letter sent from Irving to Texas Attorney General to protect requested information since Irving had not worked through all issues yet. I think it may have been done to comply with TPIA laws concerning 10 day turnaround?
