Received attorney general letter ruling OR2011-09852 in the mail. While it did not support my case on access to license plate numbers, it did substantially uphold my right of access to Duncanville's red light camera records.

Through communication with Alexis Allen, I confirmed that the attorney general also upheld my objection to their excessive fees: "we have contacted the Cost Administrator and were informed that they do not consider RedFlex a contractor, so the amount for programming is limited to $28.50 per hour."

Alexis now says Duncanville is determining how it can redact the license plate numbers from reports.

Alice Holloway responded with the attached three responses, which essentially state:

  1. On my request for communications about my original open records request: Alice has identified 9 emails and said I can pick up printed copies for $0.10 per page.
  2. On my request for Wilmer's data retention policy, there are no "electronic copies" of such a policy.
  3. On my request for several facts about their court records management systems, there are no "electronic copies" of the requested information.

I responded with three emails to the effect of:

  1. I requested electronic copies of emailed communications, and per Texas Government Code §552.228, she must produce electronic copies. I asked her to email the copies to me.
  2. I asked her to clarify whether Wilmer in fact has no policy whatsoever on data retention.
  3. I refiled my request for the facts about their court records management system that removed the limitation on electronic data.

Chase wrote back (2 days after my deadline expired), saying:

In response to your most recent email, I confirmed with the City of Ferris staff that the City does not have the technological capabilities to redact certain statutorily protected information electronically.  To comply with your request, the City must print out each citation from the previous decades and physical redact certain categories of information (Driver’s license numbers, Social Security Numbers, Car Tags, etc.).  The City stands by its earlier estimate of 400,000 documents responsive to your request.  This information would need to be compiled, reviewed, properly redacted and copied.  The Public Information Act allows the City to charge you for the documents you are requesting.
 
Despite your baseless accusations, I am following the procedures set forth in the Public Information Act.  In your 6/12/11 email, you conveniently overlooked the following portion of Texas Government Code section 552.301(a): “…if there has not been a previous determination about whether the information falls within one of the exceptions.”  Texas Attorney General Open Records Decision No. 684 (2009) provided a “previous determination” to all governmental bodies authorizing them to withhold ten categories of information without the necessity of requesting an attorney general decision. 
 
The aforementioned categories are the only information the City wishes to withhold from you.  According to Open Records Decision No. 684, no attorney general decision is needed for the City to withhold this information from you.
 
The City considers this matter closed since no payment was timely made to the City following your original request.  Please refer all future communication on this topic to me.  Thanks.
 
My response had three points:
  1. ORD 684 (2009) does not address my case. It only discusses §552.130(b), Government Code, which does permit disclosure to me.
  2. My review of correspondence between me and Ferris (including Chase) finds several violations of the law.
  3. I already filed a complaint with the attorney general's office.

Called Alice Holloway and asked for explanation why they couldn't produce the repsonsive data. Alice declined to give any technical or legal reasoning why it is not possible to produce electronic copies of Wilmer traffic ticket data, even after I reminded her that their software vendor said they could produce the responsive data. Alice also declined to explain why Wilmer muzzled their software vendor. She offered me the opportunity to visit and hand-review records. Her only reasoning was "you can't just go to the FBI and demand all their records" (this quote is paraphrased from my memory 15 minutes after the call).

I responded with three, separate, emailed open records requests for:

  • "electronic copy of Wilmer’s policies on data retention concerning emails or written, phoned, or other types of correspondences used by Wilmer employees while performing their official duties for the city"
  • "electronic copies of all communications—electronic, emailed, phoned, written, or otherwise—generated or received by Wilmer employees or any persons acting on Wilmer’s behalf, concerning my 12/3/2009 open records request (attached) for an electronic copy of Wilmer’s traffic tickets, which was routed back to you on 1/14/2011 (attached) after going through the police department", which should include "all communications directly concerning my request or tangential issues that were brought up in handling my request"
  • Several details on Wilmer's Utility Data Sytems and Accuterm products.

Called Utility Data Systems for a third time. Reached president Charles Porter. Charles said that a city official (either the city judge or city attorney--cannot recall) asked him to discuss no details with me. He said he could confirm nothing about my technical questions about the sales order.

Called Wilmer back to find a city judge or attorney. Was directed to the court (972-441-6372). The lady who answered said the city attorney is Michael Hollis, but she said I need to direct questions back to Alice Holloway, the city secretary, but she won't be in until tomorrow afternoon.

She included an excerpt of the April 22 letter, which asked me to clarify whether I am requesting the following sensitive data:

Detection Date, Detection Time, Location, Vehicle Speed, Time Camera Triggered, Duration in Intersection, Vehicle Lane, License Plate Number, License Plate State, Zip Code of Registered Owner, Citation Number, Citation Status, Status Date, Citation Issue Date and Fine Amount.

Excerpt of my response:

I am requesting all data related to each red light violation stored on Duncanville’s behalf by Redflex, so this would include the personally identifying information (PII).
 
To be clear, I am requesting this data in compliance with statutory provisions allowing for disclosure for my statistical analysis purposes. I am taking significant steps to prevent redisclosure of the data, including strong encryption; I will not contact persons listed in the data; and I will destroy statutorily-protected data once my research concludes or if I determine I no longer need it, whichever is sooner.

The letters to the TAG from Redflex showed some confusion on Redflex's part. I felt it would be good to clarify a few things.
 
First, I am not requesting that Redflex create a custom report. I am simply requesting a dump of their citation data. If Redflex has a clean, modern information architecture, they should be able to dump the data directly from their databases into a text format, provided that they include explanation of any non-obvious fields.
 
Second, I am not requiring Redflex to email the responsive data to me in one file. In my original request, I identified a few methods of transferring the data, and if neither work, I am open to other ways of transferring the data.
 
Third, Redflex was concerned that I am asking for certain data they do not track. In fact, I am only asking for facts of each red light violation that Redflex stores on Grand Prairie’s behalf.

Received attached notice from Texas Attorney General saying that my open records request has been withdrawn.

Emailed Alexis Allen, CCing Dara Crabtree, saying that this was a complete surprise and that all along I was under the impression we are awaiting an open records opinion on Duncanville's February 8, 2011 letter to the Texas Attorney General.

Alexis wrote back, emphasizing "You must respond in writing to this estimate of charges within thirty (30) business days of your receipt of this estimate or your request will be deemed automatically withdrawn."

I wrote Dara, CCing Alexis, asking for the simpler feed outlined in their response to my original proposal.

Alexis wrote back, saying:

As we’ve discussed in previous emails, your January 27, 2011 request has been deemed automatically withdrawn based on your failure to respond to the cost estimate within 30 days.  Therefore, if you still would like the information you will need to submit a new request in writing, listing the information you are requesting, and we will respond accordingly.

I received your email on February 16, 2011.  While I appreciate the legal conclusions you reached by citing one section of the Texas Transportation Code; I respectfully disagree with them, as they misstate the law.
 
First, you requested the traffic data under the authority of the Texas Public Information Act.  The City agreed to provide you the records requested, provided you pay the statutorily authorized charges the City demands to gather, compile and redact confidential information from the approximately 400,000 documents requested.  Under the Public Information Act, the City must redact certain information contained in the records you requested.  This includes, but is not limited to, Driver’s License Numbers, Motor Vehicle Registration Numbers and Social Security Numbers.  Given the technological limitations of the City, this redaction must be done manually.  The City does not possess the capability to manipulate this data electronically.  Thus, the information you requested must be provided in paper form and the above quoted fees must be paid prior to release.
 
Next, you claim that you are exempt from the very clear prohibition on motor vehicle records disclosure found in Texas Transportation Code section 730.004.  Please note that the exemption you claim under 730.007 falls under the heading of “permitted disclosures”.  This heading, coupled with the modifier “may” found in section (a) of 730.007, means that it is the City’s choice on whether to provide you the requested data.  Please compare this section 730.005, titled “required disclosures” for further evidence that the exemption you claim is discretionary on the City’s part.  Even further, please direct your attention to section 730.007(b) which states:  “The only personal information an agency may release under this section is the individual’s:  (1) name and address; (2) date of birth; and (3) driver’s license number”.  So, assuming that the City chose to release the requested information to you under an exemption found in 730.007, the aforementioned three categories of information are the only statutorily permitted types of information that could be released.  Also, given the technological limitations of the City, hard copies would have to be made of the information and the required redaction of any information not listed in 730.007(b) would occur.  Section 730.011 allows the City to adopt reasonable fees for disclosure of personal information under Chapter 730.  Once again, the City would adopt the fee structure authorized by the Texas Government Code for release of public information as its “reasonable fees”.
 
In conclusion, the City considers this matter closed unless, and until, it receives payment of $40,360.00 from you to gather, compile and redact confidential information within the 400,000 documents you have requested.  Please direct all further communications on this issue to me.
 
I wrote back to Chase and Doug at 10:15 AM:
My request was for a copy of the MySql database that, per a July 2010 open records response from Ferris, contains traffic ticket data for tickets written by Ferris police on Brazos Technology ticket writers. 40,000 printed sheets of handwritten judicial records, samples of which were included in the aforementioned July 2010 open records response, or even prints of data from the database, is not the responsive data, and I am expressly not requesting that data.
 
Note that sec. 552.228(b), Government Code, reads “If public information exists in an electronic or magnetic medium, the requestor may request a copy in an electronic medium…”. Further note that difficulty of responding to a request does not relieve a jurisdiction from compliance. For example, “the difficulty or cost of compliance does not determine whether the information is available to the public” (Texas Attorney General Open Records Decision 519, Feb. 2, 1989). Making a copy of a MySql database, or certain tables thereof, is a trivial operation, even if certain columns are deleted to redact information.
 
The use of “may” in a statue does not permit arbitrary or capricious decisionmaking. That being said, I would be happy to work with you to resolve concerns about my stewardship of this data. I have already done this to the satisfaction of the Texas Department of Public Safety, Texas Department of Transportation, and the cities of Balch Springs, Carrollton, Cedar Hill, Coppell, Dallas County (sheriff and constable patrols), Dallas, Desoto, Duncanville, Farmers Branch, Garland, Glenn Heights, Grand Prairie, Grapevine, Highland Park, Hutchins, Irving, Lancaster, Mesquite, Ovilla, Richardson, Rowlett, Sachse, Seagoville, Sunnyvale, University Park, Wilmer, and Wylie. I am confident I can satisfy your concerns, too.
 
I am fine with redacting Social Security numbers, and they is specifically addressed in 552.147, Government Code. I do not need them for my research.
 
If there is other information in this MySql database that you find is not disclosable, let me know what it is as I may have no objection to Ferris redacting it.
 
However, further note that if the MySql database in fact contains case records, they are releasable in full (unredacted) under generally accepted common law right of access to case records. SCOTUS cases affirming this includes but is not limited to:

At this point, I’d appreciate knowing if there is room for amicable resolution of this request. If not, I respectfully ask that you ask for an attorney general decision or cite prior attorney general decisions as rationales for exclusion as per 552.301, Government Code:
A governmental body that receives a written request for information that it wishes to withhold from public disclosure and that it considers to be within one of the exceptions under Subchapter C  must ask for a decision from the attorney general about whether the information is within that exception if there has not been a previous determination about whether the information falls within one of the exceptions.

The City of Ferris is willing to provide you the requested information.  It only asks that you pay for the 400,000 documents you have requested.
 
Thank you for, once again, providing me your legal analysis of the issue.  However, I request that you read Texas Attorney General Open Records Decision No. 684 (2009).  In it, you will find that a determination was issued to all governmental bodies authorizing them to withhold ten categories of information, including a copy of a Texas driver's license and a Texas driver's license number under section 552.130 of the Government Code, without the necessity of requesting an attorney general decision.  These categories are the only information the City wishes to withhold from you, and, no attorney general decision is needed.
 
The City must redact the aforementioned ten categories of information from your requested information.  But, as I have repeatedly mentioned, the City does not have the technological capabilities to redact these categories of information electronically.  So, hard copies are the ONLY way for the City to provide you the information.  What may seem like a “trivial operation” to you is, in fact, impossible given the City’s current software capabilities.
 
I wrote this to Chase and Doug at 11:06 AM:
Thank you for this email. Unfortunately, it does not resolve this request for at least three reasons.
 
First, 684 (2009) neither examines 552.130(b), Government Code, nor 730.007(d), Transportation Code. These are critical to handling my open records request. My understanding of these provisions, which was developed with prior, successful open records requests with Texas Department of Public Safety, Texas Department of Transportation, and the cities of Balch Springs, Carrollton, Cedar Hill, Coppell, Dallas County (sheriff and constable patrols), Dallas, Desoto, Duncanville, Farmers Branch, Garland, Glenn Heights, Grand Prairie, Grapevine, Highland Park, Hutchins, Irving, Lancaster, Mesquite, Ovilla, Richardson, Rowlett, Sachse, Seagoville, Sunnyvale, University Park, Wilmer, and Wylie, is that information normally restricted by 552.130(b), Government Code, which includes but it not limited to driver’s license numbers, are disclosable to me since I will comply with the conditions set forth in 730.007(d), Transportation Code.
 
Second, “the difficulty or cost of compliance does not determine whether the information is available to the public” (Texas Attorney General Open Records Decision 519, Feb. 2, 1989). I invite you to find contrary TAG decisions.
 
Third, you have not discerned whether this data falls under the Texas Public Information Act or constitutes case records, which does not fall under TPIA. It is my interpretation that this data falls under TPIA. However, if the data in the MySql database is in fact case records, then it is disclosable, in full, unredacted, under common law rights affirmed by SCOTUS, provided it’s not used for any “improper” purpose.

We obviously see the issue differently.  The City’s position has been provided to you.  The City will provide the requested documentation upon receipt of payment.  I respectfully request that any further conversation regarding this issue be ceased in order to protect the City in any future legal proceedings regarding this matter.

I appreciate the information provided, but it is not the responsive information. What I am asking for are all available details on each citation issued by the system. What was provided was a statistical summary of citations.
 
As offered in your letter, I would appreciate you contacting Redflex to request the responsive data. Redflex will be familiar with my request as I have lodged similar requests to all cities in Dallas County with red light camera programs, several of which are run by Redflex.
 
Please further note the following:
  • The request is for data in electronic form.
  • Texas Attorney General Open Records Decision OR2010-08825 (link), which in a nutshell states that data stored by Redflex on Coppell’s behalf is still subject to TPIA.
  • Because I am a student researcher who is only collecting the data for statistical analysis, who will not redisclose the data, and will not use it to contact individuals, normally non-disclosable data is in fact releasable to me. This is made clear in Texas statutes and federal code. I can clarify if more details are needed.

Lynn,

Please reference Texas Attorney General Open Records Opinion OR2010-08825 (link). This was an opinion issued about someone else’s open records request to League City (SE of Houston) about their red light camera program.

The TAG’s opinion states:

  • “Gov't Code § 552.002(a). Whether information prepared by a private party on behalf of a governmental body is in the physical custody of a governmental body is not determinative of whether the information is subject to the Act.”
  • “The test for whether the Act applies to information held by outside parties is whether: (1) the information relates to the governmental body's official duties or business; (2) the consultant acts as agent of the governmental body in collecting the information; and (3) the governmental body has or is entitled to access to the information. … We find the detection and citation of individuals for violations of the city's traffic laws, which are services Redflex provides pursuant to its contract with the city, are law enforcement activities traditionally carried out by governmental bodies. Thus, in performing these law enforcement functions, Redflex is providing services that would otherwise be undertaken by the city as part of its official duty of law enforcement. Accordingly, we conclude the photographs are collected and maintained by Redflex as an agent for the city and in connection with the city's official business.”

This would appear to establish that it is in fact appropriate for me to request this data directly from Cedar Hill. Further, as stated earlier, ATS is not subject to the Texas Public Information Act (TPIA), so it is not possible for me to satisfy this request by directly discussing this with ATS.

I realize that this may be a novel request for Cedar Hill. I want to help you make this simple in any reasonable way I can, but that can only happen in the context of Cedar Hill acknowledging and “owning” the responsibility to work with ATS to fulfill this request. I would be happy to discuss with ATS directly but only after you have cleared with ATS my right to access this data and affirmed ATS’s willingness to produce it.

If at this point you disagree with my interpretation of my rights under the TPIA, the best thing to do is to claim one or more exceptions under Subchapter C of Chapter 552, Government Code and submit this claim to the Texas Attorney General’s Open Records Division. The process is described in §552.301 (“Request for Attorney General Decision”) (link). Note that a copy of your letter to the Texas Attorney General must be furnished to me.

Received copy of letter from RedFlex Director of Operations Robert G. Salcido to Grand Prairie (attached, pages 3-5) that made these points:

  • The request includes data that they got from the NLETS that they think should not be redisclosed.
  • That releasing the data would cause substantial competitive harm and should be exempt per Texas Public Information Act Sec. 552.110.
  • No report exists, so it would require programming time to set one up. They estimate $700 (4 hrs at $175 per hour) to get the data.

Grand Prairie attorney Stephen R. Alcorn asked the Texas Attorney General for an opinion on this request.

I wrote back with these main points:

  • I am not intending to gain proprietary data.
  • I am fine discussing directly with RedFlex.
  • RedFlex selectively interpreted the laws that prohibit disclosure of confidential information. In fact, Texas Transportation Code Ch. 730 and 18 U.S.C. § 2721 both have provisions that all release of the data to me.

Per Bill Pollock:

In reviewing the data extract, you are correct in regard to the speed fields.  I performed another limited extract and the filed for Speed Limit and Alleged Speed are all blank.   We do capture Speed Limit and Alleged Speed for the creation of the Complaint,  apparently that information is not stored in the data string used in this extraction tool.  The speed range (Speeding 11-20) is used to determine the respective fine amounts for speeds within established ranges above the posted speed limit.
 
The Fine Due, Cost Due and Total Due appear to only be populated when an offense results in an arrest warrant being issued. 
 
This data is in our INCODE database as it can be seen in case inquiry.   I know of no means to electronically extract the data that you could use in your study other than the method that Tyler Technologies provided.
 
I wrote back saying I would check with Tyler Technologies for more assistance.

Called Shalonda (972-544-2110). Asked for the info that Doug had provided her. After lengthy hold (> 6 minutes), she said that all she got was about 5 pages of sample data (my interpretation). She is presenting it to the city attorney to see what can be released to me.

I asked her if it can be faxed to our departmental fax machine, and she said that should be OK.

She asked if any fees had been discussed with me, and I said that fees would be unusual for such a small job. She didn't respond to that.

Emailed Doug back basically asking if he intended for Shalonda to only have this sample data and not any electronic exports.

Dave later emailed a PDF of what Incode can provide. I wrote back saying that an Incode sales rep said it should be possible to choose Excel instead of PDF for any report. Dave replied that he had worked with an Incode support person for 30 minutes the prior day and that:

Two export files are created when you click the export file prompt. One file, a summary, can be exported into an excel format (see 1st file above). I assume the detail is in the other report which is an XML format and neither I nor the support person could get it open.

Dave also emailed a sample Excel file that he was able to produce from Incode.

Called Chief Kemp. Acknowledged that they had my request but have had serious staffing shortages (e.g., two dispachers recently left). Asked if I really needed the data from the PD. Said that, in fact, no, probably better for the data to come from the municipal court anyway. He asked about confidential data, and I mentioned how §730.007 permits it. (It says: “Personal information obtained by an agency in connection with a motor vehicle record may be disclosed to any requestor by an agency if the requestor … (2)  represents that the use of the personal information will be strictly limited to … (E)  use in research or in producing statistical reports, but only if the personal information is not published, redisclosed, or used to contact any individual.”)

He asked for me to emal him (vkemp@cityofwilmer.com), give him the list of fields I need, and give reference to how I am allowed the to get the data, and he'll take it over to the municipal court judge.

  • They are paperless. Currently on TCI court records system but migrated from a Cargill system 6 months ago. Use Brazos ticket writers.Was originally thinking he needed to produce PDFs (because he thought I may need pictures based on what I said), but later confirmed data can be exported directly to CSV or Excel from the database (or the system?).
  • Asked for faxed copy of relevant text from Transportation Code 730 authorizing me to receive personal data.

Shortly afterwards (around 4 PM) faxed him copy of transportation code plus updated version of requested fields, and sent email that fax had been sent.

Explained situation, her first question was, "Are you paying for it?" (I said "yes.")

Janis transferred me to City Clerk Cheryl Wesley.

Cheryl said it will not be possible to fulfill the request because they do not have the staff. I told her that is not an allowable reason to deny the request and that a denial will have to be filed with the Texas Attorney General.

Cheryl then said that Municipal Judge Tina Yoo instructed her not to respond. [This may violate state law that mandates a response!]

Cheryl said that Tina Yoo will next be in on February 9. I asked if I would hear back from her on or before Feb. 11, and she said "possibly."

Cheryl also confirmed that the city uses an electronic system to manage all their court records and that traffic tickets are entered into the court system.

Alice said Police Chief Kemp manages this data system. She says that he mailed me a cost estimate [no such cost estimate has been received here].

Transferred me to the police dispacher, who took a message for me and promised to put it on Kemp's desk.

Chief Kemp called me later in the day and apologized for the delay and explained that the request may have been lost due to some changes in the city. I assured him I am not worried about the (statutorily-required) 10 day response time.

I replied with email with these points:

  • It's a lawful request.
  • Several Rule 12 and Texas Public Information Act rulings or opinions affirm the right to access.
  • 20 jurisdictions have responded satisfactorily so far.
  • Balch Springs's previously-stated concern about information becoming public through this request is invalid for two reasons:
    1. Public information is public regardless of whether someone has requested it.
    2. Some of the information I requested is not public. While Texas law allows me to obtain it for research purposes, I may not disclose protected information to others.
  • I prefer to come to an agreement with Balch Springs, but if they still do not wish to comply, they will have to appeal to the Texas Attorney General's Open Records Division per 551.301, Government Code.
  • They have 10 days to respond (per law), and the time starts on 1/11/10. (This is a change from previous flexibility due to Balch Springs's resistance.)
  • A copy of the full request for clarity.

Eva Morales replied with "I have looked into some other reports to see if there is one that has all if not most of the information you are requesting and have not found one. The report I sent  you before is the report that I will be able to run.  It has the issuing officer’s name and badge #, the citation #, the violation and if it was for speeding it has the alleged speed and posted speed, the date of the violation along with the time and if the person was an adult or a minor. Please take a look at the end of the report and you will see that it totals the citations issued by race and sex.  If we need to have this broken down to show on each individual citation this would require us to print the report out and retract information before we can release it to you.   As for the defendant’s city and state, vehicle information, location and disposition of the citation this would have to be manually researched on each individual citation and this again would require someone to manually look into each and every citation.  If you would like all the information you are requesting that is not provided on the report please be advised that this would take no less than 40 hours to complete at the cost previously provided to you."

Stephanie Calame emailed with "I checked with our IT department to see if our court software uses SQL and I was told that it does not use SQL or Oracle.  The report that Eva sent you is the only report that we can pull from that software that would show the information you are requesting.  The only way that I can think of to get all of the information that you are requesting would be to manually pull all of the tickets five years back, since that is how far back we keep them, and then we would manually have to go in and redact the information that the judge feels like we should not release (ex: drivers license number, etc.).  I am not sure if this answers your questions or not.  Eva is out today but will be back Monday so if she has anything to add to this email (I cc’ed her above) she will add it then.  I hope you have a good weekend."

I am following up to my open records request that was originally routed through Sgt. Jonathan Babina.

I am a graduate doctoral student at Southern Methodist University, and I am conducting terminal praxis research that includes statistical analysis of traffic citation records from several cities.

I understand Balch Springs has concerns about my request because of the sensitive nature of the requested data. Indeed, the Texas Transportation Code Chapter 730 (Motor Vehicle Records Privacy Act) generally prohibits release of a good deal of my requested data. However, section 730.007(e) authorizes disclosure for “use in research or in producing statistical reports, but only if the personal information is not published, redisclosed, or used to contact any individual.”

Assurance of proper use:

  • I will comply with the restrictions outlined in the provision.
  •  To assure compliance with 730.007(e), my faculty research advisor, Dr. Richard Helgason, sent Sgt. Babina a letter on SMU letterhead on or shortly after August 4, 2009 affirming that this data will be used only for research and statistical purposes.
  • The raw data will be stored under AES-256 encryption with a strong key. The NSA approves this approach for top secret information (see http://www.cnss.gov/Assets/pdf/cnssp_15_fs.pdf).
  • Information protected from disclosure will be destroyed upon termination of research.

For reference, I have received citation information already from the Texas Department of Public Safety, Dallas County, and these cities: Carrollton, Cedar Hill, Dallas, Duncanville, Garland, Grapevine, Highland Park, Irving, Mesquite, Ovilla, Richardson, Rowlett, Sachse, Seagoville, and University Park. Several of these cities responded with direct exports or backup copies of the database(s) that store their traffic citation record and disposition information.

I look forward to your response, and I would be happy to discuss further if I can provide additional assurance.

I requested that the attorney reconsider, citing the Texas Transportation Code §730 exceptions for "research or statistical analysis." I also provided a copy of the notarized affidavit that Texas DPS required me to sign to ascertain compliance with §730.

Sandy will review again with the city attorney, but if he does not agree, this may trigger an appeal to the Texas Attorney General.

Sandy was receptive to exploring a direct export from their database system instead of using a software-generated report.

Clayton Gray clarified with "The source data files from INCODE are in COBOL format.  They are ODBC compliant and, as such, can be filtered into a program such as Access or Excel.  If Mr. Cambre needs a product to translate the files, Microfocus is one good source."

Despite some reserach and phone calls to two people familiar with COBOL (one is SMU's chief COBOL programmer), could not find evidence that there is such a thing as "COBOL format." COBOL is applicaiton layer, ODBC is connector to database.
