Received copy of letter from RedFlex Director of Operations Robert G. Salcido to Grand Prairie (attached, pages 3-5) that made these points:
- The request includes data that they got from the NLETS that they think should not be redisclosed.
- That releasing the data would cause substantial competitive harm and should be exempt per Texas Public Information Act Sec. 552.110.
- No report exists, so it would require programming time to set one up. They estimate $700 (4 hrs at $175 per hour) to get the data.
Grand Prairie attorney Stephen R. Alcorn asked the Texas Attorney General for an opinion on this request.
I wrote back with these main points:
- I am not intending to gain proprietary data.
- I am fine discussing directly with RedFlex.
- RedFlex selectively interpreted the laws that prohibit disclosure of confidential information. In fact, Texas Transportation Code Ch. 730 and 18 U.S.C. § 2721 both have provisions that all release of the data to me.
